Selected annually by members Governor must request names of 3 nominees from highest ranking officers of the major employee organizations representing coal miners and aggregates miners in Ohio for purposes of the appointees who only hear appeals that involve mine safety issues. The nominees must meet certain qualifications, and Governor must appoint 1 nominee in each category.
Qualifications
Governor appoints 9 members. The first 7 of these appointees are as follows: 1 representative of the public, 2 who are owners and operators of a farm or are retired farmers, 1 representative of a coal mine operator, 1 person who is learned and experienced in agronomy, 1 person who is capable and experienced in earth grading problems or is a civil engineer, and 1 person who is learned and experienced in modern forestry practices. Beginning not later than September 24, 2008, at least 1 of these appointees must be an Ohio-licensed attorney who is familiar with mining issues. Not more than 4 of these 7 appointees can be members of the same political party. The other 2 appointees are: 1 representative of coal miners and 1 representative of aggregates miners; these 2 members only sit on the Commission when it is hearing appeals that involve mine safety issues. If such a hearing involves coal mining, the coal miner representative replaces one of the Commission members who owns or operates a farm or is a retired farmer; if such a hearing involves aggregates mining, the aggregate miner representative replaces one of the Commission members who owns or operates a farm or is a retired farmer.
