Sunset Review Law does not clearly contemplate boards that may or may not be established at a local level with members appointed by local public officials. A Sunset Review Committee presumably can generally review the law that authorizes the creation of such a board.
Qualifications
(1) When the area is designated by a municipal corporation, the council must be composed of two members appointed by the mayor of the municipal corporation, two members appointed by the legislative authority of the municipal corporation, and one member appointed by the planning commission of the municipal corporation. The majority of the foregoing members must then appoint two additional members who shall be residents of the political subdivision municipal corporation.
(2) When the area is designated by a limited home rule township, the council must be composed of two members appointed by the board of trustees of the township, one member appointed by the township law director, one member appointed by the township zoning commission or, if the township has not established such a commission, the county planning commission, and one member appointed by the board of county commissioners of the county where the area is located.
(3) When the area is designated by a county, the council must be composed of one member appointed by each member of the board of county commissioners of the county where the area is located and two members appointed by the county planning commission. The majority of the foregoing members shall then appoint two additional members who shall be residents of the county.
