Chemical Dependency Professionals Board Law includes several references to "voting" members of the board. But no members are specified as being nonvoting. The member of the Board that is appointed by the Director of Mental Health and Addiction Services is specified as serving "ex officio." But ex officio means the person is a member of the Board by virtue of holding another office. Since this person is appointed they are technically not serving ex officio
Qualifications
The Governor must appoint the following voting members with the advice and consent of the Senate: 4 individuals who hold a valid independent chemical dependency counselor-clinical supervisor license or independent chemical dependency counselor license, at least 2 of whom have received at least a master's degree in a field related to chemical dependency counseling from an accredited educational institution; 2 individuals who hold a valid chemical dependency counselor III license; 1 individual who holds a valid chemical dependency counselor II license; 2 individuals who hold a valid prevention consultant certificate or prevention specialist certificate; 1 individual authorized to practice medicine and surgery or osteopathic medicine and surgery and who has experience practicing in a field related to chemical dependency counseling; and 2 individuals, at least 1 of whom is at least 50 years of age, who represent the public and have not practiced chemical dependency counseling or prevention services and have not been involved in the delivery of chemical dependency counseling services or prevention services. During their terms, the public members must not practice chemical dependency counseling or prevention services or be involved in the delivery of chemical dependency counseling services. Not more than 6 of the Governor's appointees may be of the same gender or be members of the same political party, and at least 2 must be of African, Native American, Hispanic, or Asian descent. Director of Mental Health and Addiction Services must appoint an individual who represents the Department and serves as an ex officio member of the board.
